These Terms of Service ("Terms") govern your use of the Toast mobile app and the website at toasthealth.app (together, the "Service"). The Service is operated by Ericeria Labs, a sole proprietor in Thailand, operating under the trade name "Ericeria Labs".

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Toast is a calorie and nutrition tracking application. It estimates calories and macronutrients in meals you photograph, scan, or log manually, and helps you track them against personalized targets.

Calorie and nutritional estimates are exactly that — estimates. They are not measurements. Accuracy varies by meal, lighting, portion, and similar factors. See our Health & Nutritional Disclaimer for the full picture.

2. Your account

You may use the Service anonymously, or you may choose to sign in with Apple to sync your data across devices. You are responsible for all activity that occurs through your account. Notify us at hello@ericerialabs.com if you believe your account has been compromised.

You must be at least 13 years old to use the Service. If you are between 13 and 17, you may use the Service only with the consent of a parent or guardian.

3. License to use Toast

We grant you a personal, non-transferable, non-exclusive, revocable license to download and use Toast for personal, non-commercial purposes. This license is governed by Apple's standard End User License Agreement ("Apple EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula, and by these Terms; if the two conflict, these Terms control, except where the Apple EULA cannot be modified.

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract source code from the Service
  • Use the Service to violate any law or regulation
  • Probe, scan, or test the vulnerability of the Service without our prior written consent
  • Submit content that infringes any third party's intellectual property
  • Use automated means to access the Service except through APIs we publish

4. Subscriptions

Toast offers a paid subscription with a free trial. See our Subscription Terms for the price, trial length, and cancellation details.

Important points:

  • Subscriptions are sold and billed by Apple through the App Store. We do not see your payment method.
  • Subscriptions auto-renew at the same price unless you cancel at least 24 hours before the end of the current billing period.
  • You cancel by going to iPhone Settings → your Apple ID → Subscriptions → Toast.
  • Refunds are handled by Apple. See our Refund Policy for details.

5. Your content

Anything you log into Toast — meals, photos, weights, corrections — remains yours. By submitting content to the Service, you grant us a limited, worldwide, royalty-free license to store, process, and display it back to you, and to use anonymized, aggregated versions of it (with no link to you) to improve the Service.

We never sell or transfer your content to advertisers or data brokers.

6. Our content

The Toast app, the website, the brand mark, copy, design, and software are owned by or licensed to Ericeria Labs and are protected by Thai and international copyright, trademark, and other laws. You may not copy, modify, or distribute them without our written permission.

7. No medical or professional advice

Toast provides general calorie and nutrition information. It is not medical, dietary, psychological, or therapeutic advice. Consult a licensed healthcare professional before changing your diet, especially if you have any health condition, are pregnant or breastfeeding, are under 18, or have a history of disordered eating. 8. Service availability and changes

We work to keep the Service available, but we do not guarantee uptime. We may change, suspend, or discontinue any part of the Service at any time. We will give reasonable notice for material changes that affect paid users.

9. Termination

You may stop using the Service at any time. You may delete your account from in-app Settings or by emailing hello@ericerialabs.com.

We may suspend or terminate your access to the Service if you violate these Terms, attempt to disrupt the Service, or use it fraudulently. We will refund any unused portion of a current subscription only as required by applicable law.

10. Disclaimers

The Service is provided "as is" and "as available", without warranty of any kind, express or implied, to the maximum extent permitted by law. This includes any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that calorie or nutritional estimates are accurate, that the Service will be uninterrupted, or that any defects will be corrected.

11. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim arose, or (b) the equivalent of ฿999.

We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or loss of goodwill, even if we have been advised of the possibility.

This section does not limit liability that cannot be limited under applicable law (for example, liability for gross negligence or willful misconduct).

12. Indemnification

You agree to defend and indemnify Ericeria Labs from any claim, demand, loss, or expense (including reasonable legal fees) arising out of (a) your violation of these Terms, (b) your misuse of the Service, or (c) your violation of any law or third-party right.

13. Apple as third-party beneficiary

You and we acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you.

You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.

In the event of any failure of the app to conform to applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.

14. Governing law and disputes

These Terms are governed by the laws of Thailand, excluding its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of Bangkok, Thailand.

If you are a consumer resident in the European Union, this section does not deprive you of any consumer-protection rights you have under your local law.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the app and at toasthealth.app/terms at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
